Heather Moody, a home school mom who lost her children in March due to Judge John Youngblood’s ruling in a custody case, will be back in court on Thursday in Cameron, Texas. The local community, and particularly the home school community, was shocked and outraged with the judge’s order since the only arguments made in the three-day hearing for temporary orders related to the fact that the mother homeschooled the children.
The judge referred to the forty home school observers in the courtroom who came to show support for the mom as a “mob.” He ruled that the father was “more stable” and should have the children in spite of the fact that the father traveled two to three weeks per month. He did, however, deny the paternal grandparents’ request to be joint managing conservators, but agreed they should have the children when the father traveled.
On Thursday when Heather returns to court, she will be challenging the fact that the grandparents have the youngest child almost all of the time, even when the father is in town, and she will bring up the fact that the father has refused to make evidence available. The paternal grandparents want the children, as evidenced by their original request, and the fact that the youngest child has been separated from her siblings and spends most of her time with the grandparents instead of her father seems to be a violation of the original order of the judge.
