The Wheels of Justice Grind Slowly

The federal lawsuit against CPS and individual caseworkers for the illegal taking of grandchildren from a fit grandmother continues to develop at a slow pace. Discovery is now taking place, and the case will move forward sometime in the near future. THSC Special Counsel for CPS issues, Chris Branson, tells us there is a very real chance that we will see the caseworkers, who took these illegal actions and lied to the court for almost a year to keep the grandchildren in foster care and away from their grandmother, held personally liable for these actions.

Chris was involved in the Gates case that resulted in a federal court ruling against the State of Texas and CPS for taking children from Gary and Melissa Gates without a court order. The ruling forced CPS to adopt a new policy and to issue a legal memorandum to all caseworkers warning them that if they removed children from a home without a court order, they would be personally liable.

The lawsuit against CPS is the first time that an effort has been made to hold such rogue caseworkers legally responsible for their horrible abuse of power. We continue to pray for a righteous outcome that will send a strong message to all CPS workers that they can and will be held to account for their abuse of authority.

  1. Why hasn’t the Moody case been moved out of state or the jurisdiction of Youngblood? It seems there should be just cause.

I’m so thankful for attorneys like Chris Branson and for THSC and Tim Lambert for the vision God has given him to help homeschool families continue to teach their kids at home and protect them from attacks on their faith and indoctrination by the public schools. CPS workers SHOULD be held personally accountable when they bully families this way. When I worked for MHMR, it seemed as if most of the social workers I met were young, single, or married without children, so I would imagine that they might have a lack of understanding or compassion for the parents/grandparents they are taking children from, and because “absolute power corrupts absolutely”, that they might delude themselves into thinking they really know better than the parents what is best for those children. Thanks for holding them accountable for their actions.
